Terms of Service

These Terms govern your use of the MEM Academy platform (memacademy.org and subdomains). MEM Academy is operated by MEM Academy CIC, a UK Community Interest Company. By creating an account or using the platform you agree to these Terms. If you do not agree, please do not use the platform.

These Terms are written in plain English on purpose. Where a specific service (corporate wellbeing, prison delivery, paid coaching, etc.) has additional written terms we have agreed with you, those additional terms apply alongside these.

1. Who can use MEM Academy

You must be 18 or over to create an account. Some delivery programmes (prison, attendance mentoring, youth safeguarding) involve under-18s — those programmes are delivered by vetted partners under separate written agreements and are not self-service.

2. Your account

  • You are responsible for keeping your login credentials safe.
  • You must give us accurate information when you sign up.
  • You must not share your account or impersonate anyone else.
  • We may suspend or remove accounts that breach these Terms, our safeguarding policy, or applicable law.

3. Acceptable use

You must not:

  • Use the platform to harass, threaten, or abuse other users.
  • Upload content that is illegal, hateful, sexually explicit, or that infringes someone else's rights.
  • Attempt to bypass security, scrape large volumes of data, or interfere with how the platform runs.
  • Use the platform to give regulated medical, financial or legal advice you are not qualified to provide. MEM Academy is an education and coaching platform — it is not a clinical or regulated advice service.
  • Use the platform to recruit or contact under-18s outside an approved delivery programme.

4. Paid services

Some features (e.g. corporate delivery, certain coaching tiers, the founding-partner pricing) are paid. Prices, billing periods and what's included are shown at the point of sale and in any order form or statement of work we sign with you.

Payments are processed by third-party providers (Stripe and partner gateways). We do not store full card numbers ourselves. Their terms apply to the payment itself.

5. Cancellations and refunds

You can cancel a paid subscription at any time from your account or by emailing us. Cancellation stops future renewals; we do not automatically refund the current period unless the cancellation right is mandatory under UK consumer law or your contract with us says so.

For B2B contracts (corporate, commissioner, funder), cancellation and refund terms are set in the signed order form or statement of work and override anything in this section.

A full schedule of subscription tiers and refund windows will be published here before the paid beta opens. Until then, any paid arrangement is covered by a written agreement.

6. Platform limitations

We work hard to keep MEM Academy available and accurate, but we do not guarantee uninterrupted service. Information on the platform (curriculum, training content, AI outputs) is provided for guidance and education. It is not a substitute for qualified medical, legal, financial, or safeguarding advice.

To the maximum extent permitted by law, MEM Academy CIC is not liable for any indirect, incidental or consequential loss arising from your use of the platform. Nothing in these Terms limits liability for death, personal injury caused by negligence, fraud, or anything else that cannot be limited under UK law.

7. Safeguarding limitations

MEM Academy is not an emergency service. If someone is in immediate danger, call 999 (or your local emergency number) and contact a safeguarding lead. The platform's safeguarding tooling (referrals, concerns log, attendance mentoring) is a record-keeping and triage layer for trained partners — it does not replace your organisation's own safeguarding policy or statutory duties.

We may share information with statutory authorities (police, local authority, probation, prison service) where we believe a child or vulnerable person is at risk of harm, or where the law requires it.

8. Your data and your rights

How we collect and protect personal data is set out in our Privacy Policy. You can export your account data and request deletion at any time from Account & data rights.

9. Intellectual property

MEM Academy curriculum, software, branding, and platform content belong to MEM Academy CIC or our licensors. You keep the rights to content you upload, but you grant us a non-exclusive licence to host and display it as needed to operate the platform.

10. Changes to these Terms

We may update these Terms as the platform and our paid offer evolve. We will update the "Last updated" date above and, for material changes, notify you by email or in-app banner before they take effect.

11. Governing law and contact

These Terms are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that consumers may rely on mandatory protections of the law of their place of residence.
