Terms of Service

These Terms govern your use of the MEM Academy platform (memacademy.org and subdomains). MEM Academy is operated by MEM Academy CIC, a UK Community Interest Company. The platform and its underlying intellectual property are owned by M.E.M Fitness Limited and licensed to MEM Academy CIC for delivery. By creating an account or using the platform you agree to these Terms. If you do not agree, please do not use the platform.

These Terms are written in plain English on purpose. Where a specific service (corporate wellbeing, prison delivery, paid coaching, etc.) has additional written terms we have agreed with you, those additional terms apply alongside these.

1. Who can use MEM Academy

You must be 18 or over to create an account. Some delivery programmes (prison, attendance mentoring, youth safeguarding) involve under-18s — those programmes are delivered by vetted partners under separate written agreements and are not self-service.

2. Your account

  • You are responsible for keeping your login credentials safe.
  • You must give us accurate information when you sign up.
  • You must not share your account or impersonate anyone else.
  • We may suspend or remove accounts that breach these Terms, our safeguarding policy, or applicable law.

3. Acceptable use

You must not:

  • Use the platform to harass, threaten, or abuse other users.
  • Upload content that is illegal, hateful, sexually explicit, or that infringes someone else's rights.
  • Attempt to bypass security, scrape large volumes of data, or interfere with how the platform runs.
  • Use the platform to give regulated medical, financial or legal advice you are not qualified to provide. MEM Academy is an education and coaching platform — it is not a clinical or regulated advice service.
  • Use the platform to recruit or contact under-18s outside an approved delivery programme.

Zero tolerance. MEM Academy has zero tolerance for objectionable content and abusive users. Every post, comment, reel and direct message can be reported from inside the app, and any user can be blocked instantly. Reported content is reviewed by our moderation team within 24 hours; content that breaches these terms is removed and the accounts responsible are suspended or permanently banned. Repeat or severe breaches (including harassment, hate speech, sexual content and safeguarding concerns) result in immediate removal from the platform.

4. The MEM mobile app

The MEM app (iOS and Android) gives you the consumer side of the platform: Train, Running Club, Nutrition, Mind Room, Be-Creative and MEM-Connect. Business, funder and organisation tools remain web-only. We grant you a personal, non-transferable, revocable licence to use the app on devices you own or control.

Where you download the app from the Apple App Store, Apple is not a party to these Terms, is not responsible for the app or its content, and has no obligation to provide support or handle claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Apple's own Licensed Application End User Licence Agreement also applies; where it conflicts with these Terms on app usage rules, the stricter of the two applies. You confirm you are not located in a country subject to a US embargo and are not on any US restricted-parties list.

5. Training, fitness and health

Workouts, running plans, exercise demonstrations, coach voice guidance, nutrition suggestions and mind-room content are general fitness and wellbeing guidance. They are not medical, dietetic or clinical advice, and MEM Academy does not diagnose, treat or monitor any condition.

  • Get advice from a doctor before starting a new programme if you are pregnant, injured, managing a health condition, or have not exercised for a while.
  • Stop immediately and seek medical help if you feel pain, dizziness or shortness of breath. You train at your own risk.
  • Calorie, macro and recovery figures are estimates generated from the information you enter and are not a clinical calculation.
  • Where a MEM coach or an organisation delivers sessions to you, that coach or organisation is responsible for the suitability of what they prescribe.

6. GPS tracking, Park Passport and health data

Running Club and Park Passport use your device location to record routes, distance, splits and to award park stamps. Location is only collected while you have an activity running or have asked us to show nearby places, and you can revoke the permission in your device settings at any time — the rest of the app keeps working without it.

GPS accuracy varies by device, weather and surroundings, so distances, paces, segments and personal bests are best-effort estimates. Do not rely on them for anything safety-critical. Always stay aware of traffic and your surroundings — never use the app while driving, and don't stare at your screen while running. Health and fitness data you sync (for example from Apple Health or a watch) is used to power your own training views and is handled as described in our Privacy Policy. We never sell it or use it for advertising.

7. MEM-Connect, your content and multiple accounts

MEM-Connect is a social space. You keep ownership of the posts, reels, photos, videos, comments and messages you publish, and you grant MEM Academy a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for formatting, and display that content in order to run the service and show it to the audience you chose. That licence ends when you delete the content, apart from copies we must retain for safeguarding, legal or backup reasons.

You must have the rights to everything you post, including music, footage and images of other people. You must not post anything that breaches section 3.

You may create additional accounts (for example a personal profile alongside a coach or brand profile). Every account you control is subject to these Terms, and enforcement action on one account may be applied to the others. Do not use additional accounts to evade a block, a suspension, or to mislead people about who you are.

8. AI features

Parts of the app use AI: workout and nutrition suggestions, the MEM advisor, coach voice narration, captions and the Be-Creative content tools. AI output can be wrong, incomplete or generic — check anything important before you act on it, and never treat it as medical, legal or financial advice.

You are responsible for content you generate with these tools and then publish. Prompts and generated output are processed by third-party AI providers on our behalf; do not paste other people's personal or confidential information into them. Don't use the AI tools to create content that breaches section 3, to impersonate a real person, or to generate misleading health claims.

9. XP, streaks, stamps and rewards

XP, levels, streaks, badges, MEM Stamps, leaderboard places and similar rewards are motivational features only. They have no monetary value, cannot be bought, sold, transferred or exchanged for cash, and we may adjust, reset or withdraw them — for example to correct errors, remove cheated results, or as the product changes. Manipulating tracking data or leaderboards is a breach of these Terms.

10. Paid services

Some features (e.g. corporate delivery, certain coaching tiers, the founding-partner pricing) are paid. Prices, billing periods and what's included are shown at the point of sale and in any order form or statement of work we sign with you.

Payments made on the web are processed by third-party providers (Stripe and partner gateways). We do not store full card numbers ourselves. Their terms apply to the payment itself.

Where you buy a subscription inside the iOS app, the purchase is made through Apple and billed to your App Store account. Subscriptions renew automatically unless you turn renewal off at least 24 hours before the end of the current period. Manage or cancel those subscriptions in your App Store account settings — we cannot cancel or refund them for you, and Apple's refund policy applies.

11. Cancellations and refunds

Paid subscriptions to MEM Academy are currently offered on the Starter (£25/month), Growth (£45/month) and Pro (£85/month) tiers, as shown on our pricing page. Prices include VAT where applicable and are billed monthly in advance. You can cancel a paid subscription at any time from your account or by emailing us; cancellation stops future renewals and you retain access until the end of the current billing period.

14-day cooling-off (UK consumers). If you are a consumer in the UK, you have the right to cancel a new paid subscription within 14 days of the start date for a full refund, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. To exercise this right, email hello@memacademy.org within 14 days of your first charge and we will refund the charge in full to your original payment method within 14 days. If you ask us to begin providing the service during the cooling-off period and then cancel, we may deduct a proportionate amount for the service already used.

Outside the 14-day cooling-off window, we do not automatically refund the current period unless a refund is mandatory under UK consumer law or your contract with us says so. Discretionary refunds described in FAQs or marketing pages are honoured in line with this section.

For B2B contracts (corporate, commissioner, funder), cancellation and refund terms are set in the signed order form or statement of work and override anything in this section.

12. Platform limitations

We work hard to keep MEM Academy available and accurate, but we do not guarantee uninterrupted service. Information on the platform (curriculum, training content, AI outputs) is provided for guidance and education. It is not a substitute for qualified medical, legal, financial, or safeguarding advice.

To the maximum extent permitted by law, MEM Academy CIC is not liable for any indirect, incidental or consequential loss arising from your use of the platform. Nothing in these Terms limits liability for death, personal injury caused by negligence, fraud, or anything else that cannot be limited under UK law.

13. Safeguarding limitations

MEM Academy is not an emergency service. If someone is in immediate danger, call 999 (or your local emergency number) and contact a safeguarding lead. The platform's safeguarding tooling (referrals, concerns log, attendance mentoring) is a record-keeping and triage layer for trained partners — it does not replace your organisation's own safeguarding policy or statutory duties.

We may share information with statutory authorities (police, local authority, probation, prison service) where we believe a child or vulnerable person is at risk of harm, or where the law requires it.

14. Your data and your rights

How we collect and protect personal data is set out in our Privacy Policy. You can export your account data and request deletion at any time from Account & data rights.

15. Intellectual property

The MEM Academy platform, curriculum, software, branding, and platform content are owned by M.E.M Fitness Limited and licensed to MEM Academy CIC for delivery. Third-party content remains the property of its respective licensors. You keep the rights to content you upload, but you grant us a non-exclusive licence to host and display it as needed to operate the platform.

16. Changes to these Terms

We may update these Terms as the platform and our paid offer evolve. We will update the "Last updated" date above and, for material changes, notify you by email or in-app banner before they take effect.

17. Governing law and contact

These Terms are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that consumers may rely on mandatory protections of the law of their place of residence.
